By accessing or using this Site, or booking a consultation or treatment at our St Albans or North Melbourne clinics, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree with these Terms, you must cease using the Site immediately.
 

1. Medical Disclaimer & Nature of Information
1.1 Educational Purpose Only: All content, graphics, images, information, and clinical explanations provided on this Site are for general informational and educational purposes only. 1.2 No Doctor – Patient Relationship: Your use of this Site, or the submission of an online enquiry or bookings, does not establish a formal doctor-patient relationship. 1.3 Not a Substitute for Medical Advice: The information on this Site is not intended to be a substitute for professional medical advice, diagnosis, skin cancer screening, or treatment. 2. AHPRA & TGA Compliance (Medical & Aesthetic Services)

2.1 AHPRA Guidelines: All medical services, skin cancer surgeries, and aesthetic treatments offered by Western Skin Institute are performed by registered health practitioners in accordance with the Health Practitioner Regulation National Law as enforced by the Australian Health Practitioner Regulation Agency (AHPRA). 2.2 TGA Regulations & Prescription Medicine: In strict compliance with the Therapeutic Goods Administration (TGA) regulations:

  • We do not advertise or name specific Schedule 4 (prescription-only) substances, brand names, or ingredients (such as certain anti-wrinkle injections or dermal fillers) on this Site.

  • Any aesthetic or prescription treatments mentioned generically require a face-to-face clinical consultation with a qualified medical practitioner to determine suitability. 2.3 No Guarantees of Outcomes: Medical and cosmetic procedures carry inherent risks. Individual results vary significantly based on genetics, lifestyle, and clinical factors. In alignment with AHPRA guidelines, Western Skin Institute makes no deceptive or misleading claims, warranties, or guarantees regarding the definitive outcome of any treatment.

 

3. Bookings, Cancellations, and Clinic Policies

3.1 Appointments: Appointments can be made online or via telephone. A booking fee or credit card hold may be required to secure certain appointments, particularly for extensive skin checks or aesthetic procedures. 3.2 Cancellation & No-Show Policy: We require at least 24 to 48 hours notice for any appointment cancellations or rescheduling. Failure to provide sufficient notice, or failing to attend a scheduled appointment, may result in a forfeit of your booking deposit or a cancellation fee of $[Insert Amount]. 3.3 Right to Refuse Treatment: Our medical practitioners reserve the right to refuse treatment if, in their professional clinical judgement, a treatment is deemed unsafe, inappropriate, or unlikely to benefit the patient.

4. Pricing, Payments, and Refunds

4.1 Currency & Pricing: All prices listed on this website are in Australian Dollars (AUD) and are inclusive of GST where applicable (note: medical treatments are generally exempt from GST, while cosmetic treatments may attract GST). Prices are subject to change without notice. 4.2 Australian Consumer Law (ACL): Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Victoria). For the avoidance of doubt:

  • Refunds are not provided simply for a "change of mind" once a clinical treatment has been administered.

  • If a treatment or service fails to meet a consumer guarantee under the ACL, you are entitled to a remedy, which may include a complimentary corrective treatment or a refund, depending on the nature of the issue.

 

5. Privacy & Health Records

5.1 Your privacy is paramount. Any personal or sensitive health information you provide via this Site, or during your clinical consultations, is handled strictly in accordance with the Privacy Act 1988 (Cth), the Health Records Act 2001 (Vic), and our formal Privacy Policy. 5.2 Online forms and emails sent via the internet are not completely secure. While we take reasonable measures to protect your data, you submit information through this Site at your own risk.

 

6. Intellectual Property

6.1 Unless otherwise indicated, all content on this website, including text, logos, graphics, and images, is the intellectual property of Western Skin Institute. 6.2 You may view, download, or print content for personal, non-commercial use only. Any unauthorised reproduction, modification, or distribution of our content without prior written consent is strictly prohibited.

 

7. Limitation of Liability

7.1 To the maximum extent permitted by law (including the Australian Consumer Law and the Wrongs Act 1958 (Vic.)), Western Skin Institute, its directors, and its medical practitioners are not liable for any direct, indirect, incidental, or consequential loss or damage arising out of your use of this website or your reliance on any information contained herein.
